ARTICLE 1: PREAMBLE

These terms of service are entered into between any user of the Kiprun Pacer website accessible at the link https://pacer.kiprun.com/en (hereinafter referred to as “the Site” or “Kiprun Pacer”) operated by the company DECATHLON, a European Company, registered with the Lille Trade and Companies Register under number 306 138 900 and whose registered office is located at 4 boulevard de Mons 59650 Villeneuve d'Ascq (hereinafter referred to as “DECATHLON”).

Use of the Site implies unreserved acceptance of these terms of service by the User. These conditions may be subject to modification. Therefore, it is understood that the applicable conditions are those in force on the application at the time of its use.

ARTICLE 2: ACCESS TO THE SITE

The Site allows the Kiprun Pacer application (hereinafter “the Application”) to be presented to the User.

The Site allows the User to:

  • Be redirected to the App Store and Google Play where the Application can be downloaded,
  • Access a "FAQ" (Frequently Asked Questions) relating to the operation of the Application.

ARTICLE 3: INTELLECTUAL PROPERTY

This Site is protected under intellectual property law, including copyright, designs and models, trademarks, domain names, patents, know-how, software or databases. The DECATHLON SE group and/or its partners retain ownership of all of this content and related rights.

On this content, Decathlon grants its Users a limited, non-exclusive, revocable license, without the right to sublicense, for simple access, navigation and use related to this Site. This license does not grant any other rights, in particular for commercial exploitation of this content.

ARTICLE 4: LIABILITY 4.1 Site Liability

Consultation and use of the Site is the responsibility of the User. The Site may contain links to third-party sites. By clicking on these links, the User acknowledges that the Site cannot guarantee the content of these sites, and consequently agrees to access them at their own risk.

Consequently, the Site and DECATHLON cannot be held responsible for any damage resulting from access to and/or use of these third-party sites and the information they contain.

Furthermore, the User is informed that access to the Site may be interrupted temporarily for technical reasons, in particular for maintenance reasons. The User accepts these interruptions and waives any claim in this regard.

Use of the Site by the User implies knowledge and acceptance of the characteristics and limitations of the technologies inherent in the Internet, in particular with regard to response times for consulting or querying the server hosting the Site, technical performance, and the risk of interruption.

The Site cannot be held responsible in the event of malfunction or non-functioning of the Application resulting from lack of coverage or poor 3G/4G coverage or the absence or poor quality of the GPS signal of a connected object.

The Site cannot under any circumstances be held liable in the event of an accident occurring during a sports session recommended by the Application.

Consequently, the Site and DECATHLON cannot under any circumstances be held liable, without this list being exhaustive:

  • For any network malfunction preventing the proper functioning of the application
  • For any software malfunction
  • For the consequences of any computer virus, bug, anomaly or failure
  • For any damage caused to the User's computer.

Data controller

The data that you entrust us with is processed by DECATHLON SE, 4 boulevard de Mons in Villeneuve d'Ascq, 59650.

Data processing

We process the data necessary to contact you in return and inform you about that launch of the Decathlon - Racer app in other words your email address and your name and surname.

Period of conservation

Decathlon Racer retains your personal data for the length of time necessary to alert you about the launch of the app. Your data will be erased at the end of the year 2022.

Your rights

You may consult and correct the information concerning you, or even have it erased, by withdrawing your consent. Data recipients

Your data are collected by the Kiprun Pacer (DECATHLON SE) development team. Your personal data may also be processed by technical sub-contractors tasked with data hosting or sending notifications and emails. Their access is rigorously supervised by DECATHLON. They do not have the option of using your data for any purposes other than carrying out the service.

Transfer outside the EU

At DECATHLON, we pull out all the stops to protect your personal data by complying with European regulations. Your data are hosted on servers. As part of the process of sending email notifications, some of your data are transferred outside the EU. More information on data transfer

Legal basis for the processing

Your personal data is only processed once your consent has been received. Entirely automated profiling or decision-making that produces legal effects concerning you or significantly affects you. This processing is not subject to entirely automated action or decision-making on our part.
